Are you familiar with the term IPR? IPR stands for Intellectual Property Rights which is translated from Intellectual Property Right (IPR). From that acronym, it can be concluded that IPR are rights granted to creators of intellectual works. For example, such as copyrights, trademarks, patents, industrial designs, and trade secrets.

Nowadays, there are still many people who do not understand the importance of intellectual property protection. In fact, with the existing protection, society will increasingly cultivate an attitude of innovation and creativity.

In this article we will discuss what IPR is, why IPR protection is needed, and the types of intellectual property rights. Therefore, read the following explanation thoroughly to get detailed information about IPR.

Key Takeaways:
  • Intellectual Property Rights (IPR) is the right to protection obtained by someone for having produced work related to human intellectual ability.
  • This IPR protection is important to do because it can provide legal security for creators of works while increasing creativity and innovative attitudes among the public.
  • Types of IPR are divided into two categories, namely copyright and industrial property rights. What is included in industrial property rights are patent rights, trademarks, industrial designs, copyrights, integrated circuit layout designs, and trade secrets.

Definition of Intellectual Property Rights

Quoted from Tirto.id, Intellectual Property Rights (IPR) is the right to obtain legal protection for intellectual property based on statutory regulations in the field of IPR. IPR which is a translation of Intellectual Property Right can also be understood as an understanding of property rights arising from human intellectual ability, which has a relationship with a person's personal rights (human rights).

Why can Intellectual Property Rights be included in human rights? According to Legal Now, this is because human needs to receive proper appreciation for the results of their work and intellectual results are important and primary.

The Importance of IPR Protection

From the previous description, you must already understand why this IPR protection is very much needed. Quoting from Legal Now, why IPR protection is important to do is because there is a long process required by someone until they can finally produce intellectual work, which involves deep thinking, time, energy, as well as strong innovation creativity. Not everyone can have interesting ideas, therefore the existence of IPR protection will be an appreciation for someone who has worked hard and is able to produce their intellectual work.

Unfortunately, in Indonesia itself there are still many piracy problems that often disturb those engaged in the creative, innovative, and intellectual group world. The existence of piracy issues is certainly very detrimental to them. With the existence of IPR protection, it is hoped that issues such as piracy that are detrimental can be overcome and those who produce intellectual work can get their rights fairly.

Types of IPR

Based on Tirto.id, Intellectual Property Rights (IPR) are divided into two categories, namely copyright and industrial property rights. The following is a description of the two categories.

Copyright

Copyright is an exclusive right for the creator or right recipient to announce and reproduce their work or give permission for it without reducing limitations according to applicable statutory regulations.

Industrial Property Rights

What is included in industrial property rights include patent rights, trademarks, industrial designs, copyrights, and trade secrets. The following is the explanation.

  • Patent rights, which are the exclusive rights of inventors over inventions in the field of technology for a certain period of time to carry out themselves or give approval to other parties to carry out their inventions.
  • Trademark, is a sign displayed graphically in the form of images, logos, names, words, letters, numbers, color arrangements, in two-dimensional and/or three-dimensional forms, sound, hologram, or a combination of these two elements to differentiate goods and/or services produced. Examples of trademarks often found around are such as BMW, Honda, and iPhone.
  • Industrial design, is a creation in the form of shape, configuration or composition of lines or colors, or a combination thereof in the form of two or three dimensions that gives an aesthetic impression so that it can be used to produce a product, goods, industrial commodity or handicraft.
  • Copyright, one of the intellectual properties that has the widest scope of protected objects, because it covers science, art and literature, which also includes computer programs.
  • Integrated circuit layout design, which is a creation in the form of a three-dimensional layout design of various elements. Later there will be some or all interconnections in an integrated circuit and the three-dimensional placement is intended for the preparation of making integrated circuits.
  • Trade secret, which is information not known to the public in the field of technology or business. This information has economic value because it is useful in business activities, and its confidentiality is maintained by the owner of the trade secret.
